WarrantyTerm

1.DurationandscopeofManufacturer'swarranty(the"Warranty"):<o:p>

1.1.AllnewVehiclesarecoveredbyaWarrantyunderthefollowingconditions:<o:p>

foradurationofone(1)year,includingpartsandlabour,ontheVehicle;<o:p>

for(a)one(1)additionalyear,includingpartsandlabour,exclusivelyfortheengine,gearbox,axles(b)upto200,000kmItishoweverunderstoodandagreedbytheBuyerthattheWarrantyshallterminateuponcompletionoftheearlierof(a)and(b)(mileageorduration).<o:p>

1.2.VehiclesshallbecoveredbyaWarranty,includingpartsandlabour,foratotaloffive(5)yearswithregardtocabcorrosion.ThisWarrantyshallsolelycoverdamageduetocorrosiondevelopingfromtheinsidetotheoutsideofthebodyoftheVehicles.<o:p>

1.3.TheWarrantyshallenterintoforceonthedateoffirstregistrationoftheVehiclesasstipulatedonthecertificateofregistrationoftheVehicleandinanycasenolaterthanthree(3)monthsafterthedateofissuanceofthecorrespondinginvoicebyRT.ThisWarrantyshallonlycoverpartsrecognisedasdefectivebyRT.ThisWarrantyshallinclude,atRT'ssoleanddiscretionaryoption,theexchangeorrepairofthedefectivepartsincludingthecostoflabourrequiredforthesaidexchangeorrepair.UndernocircumstancesshallservicesprovidedundertheWarrantyextendtheWarrantyterm.<o:p>

2.Limitations:<o:p>

EnforceabilityoftheWarrantyissubjectto:strictcomplianceofBuyerwiththeinstructionsforuseandmaintenanceofVehiclesasedictedbyRT;theperformanceofalltheserviceoperationscitedintheVehicledrivingandmaintenanceinstructionsintheauthorizedworkshopsnetworkofRT.ThecorrespondingservicesmustbedulyrecordedintheServiceandWarrantyHandbook.<o:p>

TheWarrantyshallbeimplementedintheauthorizedworkshopsnetworkofRTonly,andonaVehiclethathasneverbeenrepairedorconvertedoutsidethisnetwork.<o:p>

3.Exclusions:AreformallyexcludedfromthescopeoftheWarranty:<o:p>

·tyres,brokenwindows,lightbulbsandfuses;<o:p>

.normalwearandtearofvehiclecomponents;<o:p>

damageresultingfrom(i)lackofmaintenanceoruseoflubricantsoringredientsinbreachofRTrequiredspecifications,(ii)faultydriving,(iii)overloading,evenforashortperiodoftime,(iv)useofequipmentormodificationoftheVehicleinbreachofRTrecommendations;<o:p>

thecostoflabourincurredfortheperformanceofrecommendedperiodicsettingssoastoensuresmoothoperationoftheconcernedVehicle;<o:p>

costsrelatedtomaintenanceoftheVehicle,includinglubrication,oilchange,filtersandwornseals;<o:p>

stafftravelortowingoftheVehicle,costsandconsequencesofimmobilisationoftheconcernedVehicle;<o:p>

forcemajeure,actsofGod(includingfire,damagecausedbythird-parties);<o:p>

theuseandinstallationofreplacementpartsotherthanthoseprovidedundertheresponsibilityofRT.<o:p>

4.Byexpressagreement,theliabilityofRTresultingfromanon-conformityofaVehicleoramalfunctionthereofisstrictlylimitedtotheforegoing,totheexclusionofanyotherwarranty.<o:p>

5.Inanyevent,shouldRT'sliabilitybedefinitivelyrecognizedbyacourtofcompetentjurisdiction,thecompensationwhichcouldbegrantedtoBuyershallnotexceed50%(fiftypercent)oftheamountseffectivelypaidbyBuyertoRT.Buyerisrequiredtotakeanyreasonablestepstomitigatethepotentialdamagesitmaysufferfrom.<o:p>
